Legal & Terms
Silver Hawk Freight Systems, LLC
Last updated: October 17, 2026
Silver Hawk Freight is a third-party logistics management provider — not a freight broker and not a carrier. Shipments are arranged through licensed freight brokers, whose information appears on each bill of lading.
These terms govern your use of the Silver Hawk Freight customer portal and the logistics management services provided by Silver Hawk Freight Systems, LLC (“Silver Hawk Freight,” “Silver Hawk,” “we,” “us,” or “our”). By using the portal or requesting services, you agree to these terms.
1. Who We Are
Silver Hawk Freight is the logistics management service of Silver Hawk Freight Systems, LLC. We are a third-party logistics management provider.
We help customers plan, quote, book, and manage freight shipments. We are not a freight broker, we are not a motor carrier, and we do not hold broker authority or carrier authority. We never take possession of, custody of, or control over freight. We do not operate trucks or other transportation equipment, and we do not physically transport goods.
Our role is coordination and management: gathering shipment information, obtaining quotes, coordinating bookings through licensed freight brokers, tracking shipments, handling documents, and supporting communication between the customer, the broker of record, and the carrier.
2. How Shipments Work
Silver Hawk Freight coordinates quoting and booking through several licensed freight brokers. Each shipment is booked under a specific broker — the broker of record for that shipment.
For every shipment, a bill of lading is issued that names the broker and the customer. That bill of lading is the governing contract of carriage for that shipment.
The movement itself is performed by a motor carrier selected through the broker of record. The carrier’s terms and conditions and the broker of record’s terms and conditions apply to the physical movement of the freight, in addition to these terms, which govern our management services and your use of the portal.
If there is a conflict between these terms and the bill of lading, broker terms, or carrier terms for a particular shipment, the documents governing that shipment’s carriage control for matters of carriage.
3. Liability
Liability for cargo loss, damage, or shortage in transit rests with the carrier that transported the freight, under the Carmack Amendment (49 U.S.C. § 14706), the terms of the bill of lading, and applicable law.
Silver Hawk Freight is not liable for acts or omissions of a carrier or a broker, for delays in transit, or for in-transit loss of or damage to cargo. We do not assume carrier liability, and nothing in these terms or in our services makes us responsible as a carrier or broker for the movement.
Cargo claims are made against the broker of record and/or the carrier of record for the shipment. Claims are subject to the claim deadlines, filing requirements, and liability limits in the bill of lading and the carrier’s rules. At your request, we will assist you in preparing and submitting a claim and in gathering supporting documents, but the claim remains yours and is decided by the broker and carrier under their terms.
No transit time is guaranteed. Pickup dates, delivery dates, and estimated times of arrival (“ETAs”) provided through the portal, by email, or by our team are estimates only, based on information from the broker and carrier. Actual times may vary due to weather, traffic, equipment availability, facility delays, inspections, and other conditions beyond our control.
4. Quotes & Rates
Quotes shown in the portal, by email, or otherwise before booking are estimates only. A quote is not a final price until a booking is confirmed by Silver Hawk Freight for a specific shipment.
Final charges may differ from an estimate if the actual shipment differs from the information provided, or if additional services are required. This includes changes due to reweigh, reclassification, incorrect dimensions, detention, layover, liftgate, inside delivery, residential delivery, appointment scheduling, storage, redelivery, or other accessorials under the broker’s and carrier’s rules.
Once a booking is confirmed, your per-shipment price is as shown at booking confirmation, subject to adjustment for the kinds of changes described above that are verified under the broker’s and carrier’s rules and documented for that shipment.
5. Customer Responsibilities
You are responsible for providing complete and accurate information for every shipment, including:
- Accurate commodity description
- Correct NMFC item and freight class, where applicable
- Accurate weight and dimensions for each handling unit
- Accurate declared value, where you choose to declare a value
- Correct pickup and delivery addresses, contact names, and phone numbers
- Any special handling, equipment, or access requirements
You must disclose in advance, before booking, if freight is hazardous, restricted, regulated, perishable, fragile, high-value, or subject to any special legal or carrier requirements. Do not tender hazardous or restricted goods without that disclosure and without written confirmation that the shipment can be arranged.
Freight must be properly packaged, labeled, ready, and accessible at the stated pickup time and location. Delays or additional charges caused by freight not being ready, inaccessible, mispackaged, or inaccurately described are your responsibility.
If information you provide is inaccurate or incomplete, the shipment may be rebilled under the broker’s and carrier’s rules. Rebills and additional charges resulting from inaccurate information, undisclosed requirements, or accessorial services are your responsibility.
6. Insurance
Silver Hawk Freight arranges no cargo insurance unless expressly agreed in writing for a specific shipment.
Unless we have made that express written agreement for a shipment, you are responsible for your own cargo coverage — for example, under your own blanket policies or other insurance you maintain — and for understanding the carrier’s liability limits, which are not the same as insurance and may be less than the full value of your goods.
A declared value entered for a shipment is used for rating and for the carrier’s liability framework under the bill of lading. Declaring a value does not by itself purchase insurance unless expressly agreed in writing as described above.
7. Payment
Invoicing and payment terms are as set out in your customer agreement with us. If no separate written terms apply, invoices are due on the terms shown on the invoice.
We may invoice you as agent in connection with broker and carrier charges, together with our management and markup amounts. You agree to pay all confirmed charges for your shipments, including verified rebills and accessorials described in Section 4 and Section 5.
Please review invoices promptly and raise any dispute with specifics and supporting documents as soon as possible, so we can review the charge with the broker of record. Undisputed amounts remain due on their original terms.
8. Portal Use
Portal accounts are provided for your business use in arranging and managing shipments with us. Access is by invitation or approval by our team.
Account holders are responsible for safeguarding their credentials, for all activity under their accounts, and for the accuracy and completeness of information they submit through the portal. Notify us promptly if you believe an account has been compromised or if a user should no longer have access.
A booking request, quote request, or other submission through the portal is not a booking until it is confirmed by Silver Hawk Freight. Do not tender freight or rely on a pickup until you have received that confirmation.
You agree to use the portal only for lawful purposes connected with your shipments and not to interfere with the portal’s operation or security.
9. Privacy & Data
We collect and use shipment and account data — including contact information, addresses, shipment details, documents, and tracking information — to arrange, manage, track, bill for, and support your shipments, and to operate and improve the portal.
We share shipment data with the broker of record, the carrier, and service providers as needed to arrange and manage a shipment, to comply with law, and to process payment.
We do not sell your shipment or account data.
We retain records as needed for operations, accounting, claims support, and legal compliance. If you have questions about your data, contact us through the contact information provided in the portal or in your customer agreement.
10. General
We may update these terms from time to time. The current version will be posted on this page with its “Last updated” date. Continued use of the portal or our services after an update constitutes acceptance of the current version.
If any part of these terms is held unenforceable, the remaining parts remain in effect.
These terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute arising under these terms that is not governed by the bill of lading, broker terms, or carrier terms for a specific shipment will be resolved in the state or federal courts located in Utah, unless otherwise agreed in writing.
These terms, together with your customer agreement (if any) and, for each shipment, the bill of lading and the applicable broker and carrier terms, form the complete understanding for our management services.
